Immigration
Immigration laws govern the ways in which people from other countries can come to the U.S. to visit, to study, to work for a while, or to move here permanently, eventually becoming legal permanent residents or U.S. citizens.
U.S. immigration law involves complicated interactions between various laws and regulations, categories, deadlines, exceptions, and waivers. While some people try to navigate the immigration process on their own, it is often more efficient, and you are more likely to be successful, if you hire a knowledgeable attorney as your helper and guide.
Because so many people seek to enter the U.S. each year, long delays are often a part of the immigration process. You should be prepared for such delays, as well as for a lot of paperwork. By hiring an attorney you would be putting that work in the hands of a professional, while you concentrate on the other responsibilities in your life.
The Florida-based Flaxman Law Group has offices in Hollywood, Homestead, and Miami. Our attorneys are prepared to help you if you are trying to
- obtain a work-related visa
- obtain one of the visas reserved for people of extraordinary ability
- obtain a student visa
- obtain a "green card"
- obtain a fiance visa
- obtain a visa reserved for religious workers
- adjust your status to that of legal resident
- adjust your status based on marriage
- fight deportation (or "removal")
- sponsor a family member for family-based immigration
- become a U.S. citizen
- request asylum or protection under the Convention Against Torture
- or obtain other immigration benefits or forms of relief.
In Florida as throughout the country, immigration-related issues are addressed in special Immigration Courts, whose rules and procedures are different than those that apply in other civil courts in the U.S. Appeals of Immigration Court decisions are heard by the Board of Immigration Appeals, and the decisions of the Board may themselves be appealed to the local federal Circuit Court. A small number of appeals reach all the way to the U.S. Supreme Court. However, while a loss in Immigration Court is not the end of the road, any loss makes it much more difficult to win in subsequent levels of litigation. It is important, therefore, to make your case as strong as possible from the very first effort.
